Copyright and takedown policy
EveryBod respects the rights of people who make things, and we expect our members to do the same. Members can add content to EveryBod, such as how-to videos, profile photos, workouts and comments. If you believe something on EveryBod copies your work without permission, this page explains how to tell us.
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).
Send a copyright notice
Email or mail a notice to our copyright agent:
Copyright Agent EveryBod, LLC 6344 Lexington Ave Los Angeles, CA 90038 Email: legal@everybodfit.com
To be valid, a notice must include all of the following:
- •Your physical or electronic signature (a typed name is fine), as the copyright owner or as someone authorized to act for the owner.
- •A description of the copyrighted work you say was copied.
- •Where the material is on EveryBod. A link is best. Otherwise describe it clearly enough for us to find it (for example, the exercise name and the member who posted the video).
- •Your contact details: name, mailing address, and an email address or phone number.
- •A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
- •A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.
If your notice is missing something, we will write back to ask for it.
What we do
When we receive a complete notice, we remove or disable access to the material promptly. We tell the member who posted it and may send them a copy of your notice, including your contact details.
Please do not send a notice unless you are sure. Anyone who knowingly makes a materially false claim that material is infringing can be liable for damages, including costs and attorneys' fees (17 U.S.C. § 512(f)).
If your content was removed
If you believe we removed your content by mistake or because it was misidentified, you can send a counter-notice to the same address. It must include:
- •Your physical or electronic signature.
- •What was removed and where it appeared before it was removed.
- •A statement, under penalty of perjury, that you believe in good faith that it was removed because of a mistake or misidentification.
- •Your name, mailing address and phone number.
- •A statement that you consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any federal court where EveryBod can be found) and that you will accept service of legal papers from the person who sent the original notice.
We will send your counter-notice to the person who made the claim. Unless they tell us, before we restore it, that they have started a court action, we will restore the material between 10 and 14 business days after we receive your counter-notice.
Repeat infringers
We end the accounts of members who repeatedly infringe copyright, in appropriate circumstances.
Reporting inside the app
You can also flag a video or a profile in the app: open the menu on it, tap Report, and choose Copyright. We review these reports. An in-app report is not a legal notice, so if you own the copyright, email the notice described above. It is the quickest way to have something removed.
